Welcome to LHD Tree Service! This website, located at www.lhdtree.com, including all subdomains, and our social media pages (collectively, the “Site”), is owned and operated by LHD Tree Service. Please read these Terms of Use, our Privacy Policy, and any related terms carefully, as they outline your rights and responsibilities. By using the Site, you agree to these Terms. If you don’t agree, please refrain from using it.

Acceptance of Terms

By checking the box to accept these Terms or by browsing the Site, you agree to be bound by these Terms and any updates posted here. We may amend these Terms at any time, and changes take effect immediately upon posting. Your continued use of the Site signifies your acceptance of the latest Terms, though major changes won’t apply retroactively to past disputes.

By agreeing, you also waive your right to sue in court and opt for binding arbitration to resolve disputes, as detailed in the “Dispute Resolution” section below, waiving your right to a jury trial.

Rules of Conduct

Disclaimer of Warranties

No Third-Party Beneficiaries

Only you and LHD Tree Service enforce these Terms, except payment networks as third-party beneficiaries for payment terms.

Dispute Resolution

Arbitration and Class Waiver

Disputes will be resolved by binding arbitration, not courts, except for small claims or IP protection actions (filed in Houston, TX courts). You waive jury trials and class actions. Arbitration follows JAMS rules (http://www.jamsadr.com), limited to individual claims.

Arbitration Process

Send a Dispute Statement to info@lhdtree.com first. If unresolved in 30 days, file a Demand for Arbitration per JAMS rules. Arbitration occurs where you reside unless agreed otherwise. Claims over $10,000 follow JAMS hearing rules.

Arbitrator’s Decision

The arbitrator’s ruling is final, limited by warranty and liability terms. Prevailing claimants may get attorney fees if allowed by Texas law; we waive this right if we win.

Fees

We cover JAMS fees for arbitrations we initiate or you start.

Time Limit

Claims must be filed within one year, overriding longer Texas statutes of limitations (e.g., Tex. Civ. Prac. & Rem. Code § 16.003), unless prohibited by law.

Opt-Out

Opt out of arbitration within 30 days of your first visit by writing to 13403 Ann louise Rd, Houston, TX 77086, or emailing lhdtreeservice@live.com with your details. Reject changes to this section within 30 days of updates.

General Terms

These Terms are the full agreement between us, superseding prior understandings. Invalid provisions won’t affect the rest. You can’t assign these Terms without our consent; we may assign freely. Notices are via email or Site posting. Non-enforcement doesn’t waive rights. No partnership is created.
